XM and Sirius announce merger deal

On 19 February 2007, XM Satellite Radio and Sirius Satellite Radio announced a move that will change the face of satellite radio in the United States and Canada: XM and Sirius will be merging, creating a single satellite radio provider.

Multi-million dollar losses, combined with increasing competition from internet radio, downloadable music, and HD radio were factors in this merger.

Mel Karmazin, CEO of Sirius Satellite Radio, described the problem: “We don’t want to take subscribers from XM. We won’t make money that way. We need new subscribers.” Likewise, XM executives say they can’t succeed by stealing Sirius subscribers. This leaves both companies with the problem of attracting new customers and distinguishing their brand, while at the same time trying to convince potential customers to pay $12.95 a month for radio, something that people are used to getting for free. Even if one company were to force the other out of the marketplace, the remaining company would have won a Pyrrhic victory, without enough capital remaining to take advantage of the situation.

The solution: make a deal now, while both companies are both strong and in a position to expand their technologies and services. That’s exactly what they plan to do: In press releases and news postings on both of their web sites, both companies have pledged to make the combined company better than either service by itself. “You’ve heard of 1+1=3,” Karmazin said during an invester conference call, “that’s what this is.”

Pending approval of the deal, each share of XM stock will be replaced with 4.6 shares of Sirius. Each company’s stockholders will retain approximately 50% of the joined company. Sirius CEO Mel Karmazin will retain his CEO title in the new company, and XM chairman Gary Parsons will retain his. XM CEO Hugh Panero will retain his position until the merger is complete, which should happen near the end of 2007.

Dell joins Microsoft-Nortel VoIP Team

Dell Inc. announced on Tuesday that it will partner up with the Microsoft-Nortel Innovative communications alliance (ICA) team to sell Unified Communications and VoIP products.

The announcement on Tuesday the 16th of October 2007 includes Dell selling VoIP, data and wireless networking products from Nortel and the Microsoft Office Communications Server 2007 and other unified communications products.

The partnership with both manufacturers should allow Dell to provide a pre-integrated solution.

In March 2007, competitors IBM and Cisco announced they would join in the competition for developing unified communications applications and the development of open technologies around the unified communications and collaboration (UC2) client platform an application programming interfaces (APIs) offered by IBM as a subset of Lotus Sametime.

“We want to make it simple for our customers to deploy unified communications so their end users can get access to all their messages in one place – whether its e-mail, phone or mobile device. This will pave the way for more business-ready productivity tools,” said vice president of solutions, Dell Product Group, Rick Becker.

Canadian top court strikes down private medicare ban in Quebec

Canada’s top court has struck down Quebec’s bans on private health care insurance, citing an increased risk to the life and health of Canadians. [1]

The Supreme Court of Canada ruling looked into a patient’s right to pay for faster service in a system that currently treats patients on the basis of equal access to medical care, regardless of income. [2]

Quebec patient George Zeliotis, a chemical salesman who waited in pain for more than a year in 1997 to have his hip replaced, said he should have had the right to pay for surgery.

Under public health care, it’s forbidden to pay for services covered under the system.

Despite free medical treatment, there are often long waiting lists for operations and services with current public health care.[3]

Together with physician, Dr. Jacques Chaoulli, Mr. Zeliotis launched a challenge to the Supreme Court of Canada, after losing their fight in Quebec’s lower courts, arguing that having to wait for surgery violates a patient’s constitutional right to life, liberty, and security of the person. [4]

Mr. Zeliotis and Dr. Chaoulli argued that being able to pay for private medical services wouldn’t be detrimental to the public health care system.

The Quebec Superior Court and the Quebec Court of Appeal had dismissed the case, ruling that the provincial law’s intent was not to discriminate among patients and to provide health care based on need rather than a patient’s ability to pay.

The Canadian Medical Association said the Superior Court of Canada ruling could “fundamentally change the health-care system in Canada as we now know it” but declined to comment any further until it had time to study the decision. [5]

Asbestos controversy aboard Scientology ship Freewinds

Controversy has arisen over the reported presence of blue asbestos on the MV Freewinds, a cruise ship owned by the Church of Scientology. According to the Saint Martin newspaper The Daily Herald and the shipping news journal Lloyd’s List, the Freewinds was sealed in April and local public health officials on the Caribbean island of Curaçao where the ship is docked began an investigation into the presence of asbestos dust on the ship. Former Scientologist Lawrence Woodcraft supervised work on the ship in 1987, and attested to the presence of blue asbestos on the Freewinds in an affidavit posted to the Internet in 2001. Woodcraft, a licensed architect by profession, gave a statement to Wikinews and commented on the recent events.

According to The Daily Herald, the Freewinds was in the process of being renovated by the Curaçao Drydock Company. The article states that samples taken from paneling in the ship were sent to the Netherlands, where an analysis revealed that they “contained significant levels of blue asbestos”. An employee of the Curaçao Drydock Company told Radar Online in an April 30 article that the Freewinds has been docked and sealed, and confirmed that an article about asbestos ran in the local paper.

Lloyd’s List reported that work on the interior of the Freewinds was suspended on April 27 after health inspectors found traces of blue asbestos on the ship. According to Lloyd’s List, Frank Esser, Curaçao Drydock Company’s interim director, joined Curaçao’s head of the department of labor affairs Christiene van der Biezen along with the head of the local health department Tico Ras and two inspectors in an April 25 inspection of the ship. “We are sending someone so that they can tell us what happened, where it came from, since when it has been there,” said Panama Maritime Authority’s director of merchant marine Alfonso Castillero in a statement to Lloyd’s List.

The Church of Scientology purchased the ship, then known as the Bohème, in 1987, through an organization called Flag Ship Trust. After being renovated and refitted, it was put into service in June 1988. The ship is used by the Church of Scientology for advanced Scientology training in “Operating Thetan” levels, as well as for spiritual retreats for its members. Curaçao has been the ship’s homeport since it was purchased by the Church of Scientology.

According to his 2001 statement, Lawrence Woodcraft had been an architect in London, England since 1975, and joined Scientology’s elite “Sea Organization” (Sea Org) in 1986. He wrote that he was asked by the Sea Org to work on the Freewinds in 1987, and during his work on the ship “noticed a powdery blue fibrous substance approximately 1 ½” thick between the paint and the steel wall,” which he believed to be asbestos. He also discovered what he thought was blue asbestos in other parts of the ship, and reported his findings to Church of Scientology executives. Woodcraft discussed his experiences in a 2001 interview published online by the Lisa McPherson Trust, a now-defunct organization which was critical of the Church of Scientology.

The Freewinds regularly inspects the air quality on board and always meets or exceeds US standards.

Church of Scientology spokeswoman Karin Pouw responded to Radar Online about the asbestos reports, in an email published in an article in Radar on May 1. “The Freewinds regularly inspects the air quality on board and always meets or exceeds US standards,” said Pouw. She stated that two inspections performed in April “confirmed that the air quality is safe,” and asserted that the inspections revealed the Freewinds satisfies standards set by the United States Occupational Safety and Health Administration and the U.S. Clean Air Act.

Pouw told Radar that “The Freewinds will be completing its refit on schedule.” The Church of Scientology-affiliated organization Citizens Commission on Human Rights (CCHR) had been planning a cruise aboard the Freewinds scheduled for May 8, but according to Radar an individual who called the booking number for the cruise received a message that the cruise had been delayed due to ongoing work on the ship. Citing an article in the Netherlands Antilles newspaper Amigoe, Radar reported on May 6 that a team from the United States and supervised by an independent bureau from the Netherlands traveled to Curaçao in order to remove asbestos from the Freewinds.

“I stand by everything I wrote in my 2001 affidavit,” said Lawrence Woodcraft in an exclusive statement given to Wikinews. Woodcraft went on to state: “I would also comment that if the Church of Scientology claims to have removed the blue asbestos, I just don’t see how, it’s everywhere. You would first have to remove all the pipes, plumbing, a/c ducts, electrical wiring etc. etc. just a maze of stuff. Also panelling as well, basically strip the ship back to a steel hull. Also blue asbestos is sprayed onto the outer walls and then covered in paint. It’s in every nook and cranny.”

Many Scientologist celebrities have spent time aboard the Freewinds, including Tom Cruise, Katie Holmes, John Travolta, Kelly Preston, Chick Corea, Lisa Marie Presley, Catherine Bell, Kate Ceberano, and Juliette Lewis. Now magazine reported that Tom Cruise has been urged to seek medical attention regarding potential asbestos exposure, however a representative for Cruise stated he has “absolutely no knowledge” of the recent asbestos controversy. Cruise, Holmes, Travolta and Preston have celebrated birthdays and other events on the Freewinds.

There is not now and never has been a situation of asbestos exposure on the Freewinds.

In a May 15 statement to the United Kingdom daily newspaper Metro, a representative for the Church of Scientology said that “There is not now and never has been a situation of asbestos exposure on the Freewinds.” The Asbestos and Mesothelioma Center notes that agencies have recommended anyone who has spent time on the Freewinds consult with their physician to determine if possible asbestos exposure may have affected their health.

Raw blue asbestos is the most hazardous form of asbestos, and has been banned in the United Kingdom since 1970. Blue asbestos fibers are very narrow and thus easily inhaled, and are a major cause of mesothelioma. Mesothelioma is a form of cancer which can develop in the lining of the lungs and chest cavity, the lining of the abdominal cavity, or the pericardium sac surrounding the heart. The cancer is incurable, and can manifest over 40 years after the initial exposure to asbestos.

“This is the most dangerous type of asbestos because the fibres are smaller than the white asbestos and can penetrate the lung more easily,” said toxicologist Dr. Chris Coggins in a statement published in OK! Magazine. Dr. Coggins went on to note that “Once diagnosed with mesothelioma, the victim has six months to a year to live. It gradually reduces lung function until the victim is no longer able to breathe and dies.”

Cialis blog controversy is major war of words

Pharmaceutical giant Eli Lilly and Company is currently engaged in a war of words with John Mack, editor of the monthly newsletter Pharma Marketing News. Mack and Eli Lilly are debating the origin of the Cialis Blog, a long-running Web site containing information about the popular anti-impotence medication Cialis. The Web site features information about Cialis’ clinical trials and commentary from Lilly ICOS executives.

Mack has suggested that Eli Lilly and Company sponsors the Cialis Blog. However, Lilly ICOS has asserted that it has nothing to do with the Web site.

Mack disputed Eli Lilly’s version of events calling the Cialis Blog “too far-fetched to be believed” and an example of Lilly’s “incredible incompetence.” Another blog, Envisioning 2.0, notes that the “Cialis blog is not endorsed by the powers that be at Lilly ICOS, according to Lilly spokesperson Kindra Strupp.”

Pharmaceutical Executive first mentioned the Cialis blog in an October 2004 article about pharmaceutical blogging. The author of the story assigned responsibility for the blog to Lilly ICOS without attribution.

Other bloggers have posted comments on Envisioning 2.0 and Mack’s Pharma Marketing Blog suggesting that the Cialis Web site may be unofficial. They cite evidence from a WHOIS search indicating that Mircea Piturca of Romania apparently registered the blog.

Mack and bloggers commenting on the debate have all urged Eli Lilly to take action against the site. They all believe it is in the company’s best interest to have the site shuttered.

Charlottetown, P.E.I. residents rally to support restaurant

The owners of the Noodle House Restaurant of Charlottetown, Prince Edward Island (P.E.I.), Canada were overwhelmed by community support Tuesday when the restaurant overflowed with customers, cards, flowers, and personal pleas to not leave the province.

According to CBC News Prince Edward Island, the recent outpouring of support occurred after Tommy and Lina Ko, the restaurant owners, announced they would close the restaurant and leave the province following an incident two weeks ago, when groups of up to 200 teens from two nearby schools surrounded the restaurant, pelting it with snowballs, and threatening the Kos. Charlottetown Police Chief Paul Smith told CBC PEI that his force is ready to take whatever action is necessary to crack down on the behaviour and last week started videotaping over lunchtime when most of the misbehaviour has taken place. Police noted that they have received complaints from other businesses, pedestrians, and drivers in the busy “fast food alley” and intend to seek co-operation from the schools in identifying the main culprits.

However, a CBC PEI story from October, 2002, reported the Kos asking police to do more to stop the littering and other vandalism in the area including having signs smashed, windows broken, and fireworks set off in front of their restaurant. At that time, Deputy Chief Richard Collins told CBC PEI: “You can’t have upwards of 1,500 to 2,000 students in and around that area at dinner hour and not expect for some of them to misbehave,” but promised to continue patrols and try to teach the students respect of property.

Tommy Ko told CBC News that he was overwhelmed by the support this week and in thanks put on a surprise free buffet, though customers insisted on paying anyway. Nevertheless, after fighting the harassment for some five years, the Kos say they still are not sure they want to stay.

Sales of Jackson songs and memorabilia rise after his death

The death of Michael Jackson on Thursday has caused retail demand for his songs and for memorabilia to increase.

Yesterday, the top nine selling items at Apple’s iTunes Store were albums by Jackson, with first and second being a “hits” album and the 1982 album Thriller.

Amazon.com similarly reported selling more Jackson merchandise in the 24 hours following his death than it had sold in the preceding 11 years, and that sales of Jackson CDs accounted for 60% of its total business on Thursday. Yesterday morning the top seller in the album chart for Amazon’s U.K. division was Off the Wall, followed by Bad and Thriller in second and third places, respectively.

Many stores, including Graywhale CD Exchange in Salt Lake City, several record stores in Danville, Virginia, and many retailers in New Zealand, have all reported selling out of Jackson’s CDs and DVDs. The flagship store of Tower Records Japan, in Shinjuku, sold out of several of Jackson’s DVDs and ran low on several other items including CDs. The Danville Register Bee recommended to its readers that if they had record players they should investigate antique and charity shops, after one antique shop reported discovering three Jackson Five vinyl albums in its basement.

The effect of the increase in sales had an effect on stock prices. Midday yesterday, Apple shares rose around 2%, Amazon shares rose around 1.3%, and eBay shares rose by 0.64%. Stock market analysts predict that this will be a short-term effect, however. Scott Fullman, an investment strategist at WJB Capital Group in New York, stated “This is going to be one of these events that will have an immediate impact and then wane out in a week or two.”.

In Las Vegas, 21 items of Jackson memorabilia, including handwritten lyrics for Jackson’s song “Bad” and the shirt that Jackson wore on his Victory Tour in 1984, sold at auction yesterday at the Planet Hollywood Resort and Casino for a total of USD$205,000, with the shirt, at USD$52,500 the most expensive individual item.

eBay has reported an increase in individuals auctioning Jackson memorabilia. These range from records to a Fedora hat signed by Jackson.

Also for sale on eBay and elsewhere are tickets to the This Is It concerts, at the O2 arena, where Jackson had been scheduled to perform. Ticket sellers such as Ticketmaster, Seatwave, and AEG Live have announced that they will be refunding concert tickets. But under standard contract law such refunds only apply to the original purchasor of the ticket, who dealt with the ticket companies directly. Anyone buying a ticket on eBay only has recourse against the seller on eBay that they bought from, and even then only if it was explicitly stated in the terms and conditions of the particular eBay sale that a refund was available.

At the 2009 Glastonbury Festival, stalls have been selling commemorative T-shirts to Festival attendees, with various different slogans including “Michael Jackson R.I.P 1958–2009” and “I was at Glasto 09 when Jacko died”. T-shirt vendors also appeared outside of the UCLA Medical Center where paramedics took Jackson, proferring for USD$10 T-shirts with the slogan “in loving memory of Michael Jackson” and a silhouette of Jackson, although they had few takers.

In Union Square in New York, one street artist was selling hand-made buttons that have pictures of Jackson’s album covers on them. In Times Square, another T-shirt vendor was selling T-shirts printed with copies of the front page of USA Today that reported Jackson’s death.

One observer, Allison Southwick (a Better Business Bureau spokeswoman), commented “I’m honestly expecting to see a Web site pop up by the end of the day selling Michael Jackson commemorative plates.” Whilst such commemorative plates have yet to appear, collectors have been offering commemorative stamps of Jackson for sale on eBay and elsewhere. Several commemorative stamps of Jackson already exist. Saint Vincent and the Grenadines issued $5, $2, $1, and 60¢ Michael Jackson stamps in 1985, as part of its Leaders Of The World series. Tanzania issued a 350s stamp, part of a Famous Black Entertainers set, in 1990. Guinea issued a 500f stamp in 1991. St Vincent issued another $2 Jackson stamp in 1991, as part of Famous Entertainers series. And Grenada issued a 60¢ Jackson stamp, part of its Gold Record Winners series in 1992.

Gore Vidal once remarked of the death of rival Truman Capote that it was a “good career move”. The death of an artist does serve to increase the popularity of their works. People have speculated whether this will be a temporary or a permanent thing for Jackson.

Jim Lentz, who is the Chief Operating Officer of American Royal Arts (a memorabilia dealership in Boca Raton), asked “Is he Elvis or Marilyn Monroe, or is he Mike Tyson?”.

Elvis Presley died at 42, officially of heart failure. Stores sold out of his records and souveniers within hours of the news of his death. In the 20 years following his death, RCA Records sold approximately 400 million of his recordings.

In the days and weeks immediately following Presley’s death, RCA had to sub-contract pressing to other companies, as it was unable by itself to keep up with demand. Sony Corporation announced yesterday that it had received “unprecedented” levels of orders for CDs of Jackson’s music, and was considering boosting production. It had received 150,000 orders for CDs at its music unit in Tokyo. “The amount is unprecedented for one day and we think we need to consider increasing the production of CDs that we plan to sell from July.” said a spokesman for the company. Amazon has been informing customers buying Jackson CDs that they might have to wait between 1 and 3 weeks for their orders to be shipped.

Augusten Burroughs on addiction, writing, his family and his new book

I had an unofficial phone call from Gay Talese last Tuesday. He had just flown back from Colombia and he was cranky. “I’m happy to do an interview with you,” he said, “but what the hell could you ask me that’s not already out there? Have you even bothered to look?!”

“Jeez, Mr. Talese, lots of things,” was my response. I lied. The truth is that when I call people to interview them, I do not have a set of preconceived questions. My agenda is to talk to them and gain a sense of who they are; to flesh them out as humans. To find out what they think about the world around them at that moment. With Gay Talese I had little interest in talking about Frank Sinatra Has a Cold and with Augusten Burroughs I had little interest in discussing Running with Scissors. I want to know what they think about things outside of the boxes people have placed them in.

With a memoirist like Burroughs, even this is a challenge. What parts of his life he has not written about himself, other interviewers have strip-mined. When we met for dinner at Lavagna in the East Village, I explained to Augusten this issue. I suggested we make the interview more of a conversation to see if that would be more interesting. “Instead of you in the catbird seat,” I said, “let’s just talk.”

We struck an instant rapport. What set out to be an hour and half interview over dinner had turned into four hours of discussion about our lives similarly lived. I removed half of the interview: the half that focused on me.

Texas Commissioner of Agriculture visits schools to kick off National School Lunch Week

US Texas Commissioner of Agriculture Todd Staples visited Orr Elementary school in Tyler, Texas on Wednesday to kick off National School Lunch week for the state. Commissioner Staples spoke to over 200 students during lunch about the importance of eating healthy. “During the old days, the Three R’s in school meant ‘Reading, ‘Writing and ‘Arithmetic’ […] but I want you students to remember the three E’s: Education, Exercise and Eating right,” he stated.

The Commissioner asked students a variety of questions about state trivia such as the names of the state bird, the state tree and the state fruit. Students who answered correctly were awarded prizes.

During a short press conference following, Commissioner Staples stated his concerns regarding the health of children in Texas: “Current indications are that over 30 percent of children in [the United States of] America are struggling with childhood obesity. Estimates indicate that this issue alone can cost this county one-billion dollars in healthcare costs per year in the future.” “I applaud the city of Tyler for taking the Fit City challenge,” the Commisioner further stated.

National School Lunch Week runs from October 11th–15th. President Barack Obama issued a presidential proclamation naming October 11th–15th the National School Lunch Week.
